Members benefit from a practical familiarity with complex, cross-jurisdictional investigations and prosecutions, being well-placed to act in cases requiring coordination and cooperation amongst multiple authorities.

Extradition

7BR’s barristers advise and represent requested persons as well as acting for judicial authorities. Members assist at the earliest stage with advising judicial authorities and potential requested persons on prospective proceedings, and at short notice when proceedings have begun and rapid advice or representation is required. Members have particular expertise in cases where requested persons are sought in connection with financial crime, money laundering, bribery and corruption. Notable cases in which 7BR members have been instructed include the below.

  • AG of Jersey v Gichuru & Okemo: extradition and prosecution of a former Kenyan Finance Minister and former head of the Kenyan electricity utility for corruption related offences.
  • USA v Fesenko: acting for a Requested Person facing extradition for wire fraud valued at $137m in the US.
  • Advising an individual facing extradition to the Greek island of Naxos for manslaughter.
  • Advising a Cyprus national on the risks of extradition to UK on charges of attempted murder.
  • Advising a Polish national on the merits of an appeal to the UK Supreme Court, of a refusal by the High Court to quash extradition to Poland under an EWA.

Mutual legal assistance

7BR is a leading and well-respected international multi-disciplinary set whose members are regularly instructed in connection with cross-jurisdictional investigations and prosecutions, and are trusted to advise and act in matters of significant complexity, confidentiality and sensitivity. Chambers’ thriving crime, financial crime, regulatory, and offshore and international practices inform members’ approach to formulating and responding to requests for assistance, and advising affected individuals. Members provide speedy, thorough, and practical advice as well as assistance with drafting requests and responses and liaising with international authorities.

Notable cases in which 7BR members have been instructed include the following examples.

  • The Privy Council appeals in Tai Chi Fang and other v HM’s AG for Jersey, on the status of a requesting State in mutual legal assistance proceedings.
  • AG for Jersey v Bhojwani & Ors: instructed by the Attorney General between 2004 and 2010 to assist in recovery of funds looted from Nigeria by the late General Abacha and associates. Through mutual legal assistance and other channels of international co-operation, they were able to return in excess of $200 million to Nigeria.
  • Durant International Corporation v AG for Jersey: instructed by the Attorney General for Jersey in relation to two judicial review challenges to the exercise of mutual legal assistance powers by the Attorney General.
  • R v Obasi: liaising with the Japanese Ministry of Justice by letter and on the ground in Japan, in order to obtain assistance in relation to extradition proceedings.
