Olivia Bennett has a busy multidisciplinary practice and welcomes instructions within Chambers’ core areas of expertise.

Olivia practises within employment, public inquiries and reviews, Court of Protection, family, clinical negligence and personal injury.

Olivia was instructed as a key member of the Thirlwall Inquiry team between 2024-2026. The Inquiry investigated events at the Countess of Chester and the recommendations can be found here. As a consequence of her experience, Olivia is now a member of the Attorney General C-panel.

She recently assisted in the Langdale Review and was led by Rachel Langdale KC. The review was commissioned by the Chief Constable of the Police Service Northern Ireland (PSNI) to provide independent scrutiny and constructive challenge in relation to the PSNI’s work addressing violence against women and girls.

Prior to joining the Bar, Olivia obtained a First Class degree in Cardiac Physiology and received a prize for achieving the highest grade in the cohort. She studied the Barrister Training Course at Nottingham Law School, funded in full by a Major Exhibition Award from the Honourable Society of the Inner Temple.

Legal Expertise

Employment

Olivia practises in all areas of employment law and has represented employers and employees across the public and private sector in matters relating to unfair dismissal, discrimination, harassment, redundancy and whistleblowing.

She successfully appeared in a 5-day trial for a multinational media company against an employee who alleged unfair dismissal, age discrimination and incorrect calculation of notice pay. Each ground of complaint was successfully dismissed.

Olivia successfully represented an employee in a 3-day trial, the case concerned unfair dismissal and disability discrimination. Both grounds of complaint were upheld.

Olivia is skilled at drafting pleadings including grounds of complaint and grounds of resistance. She is adept at advising on the merits of cases.

She is a member of the Attorney General C-Panel and regularly acts in employment proceedings through the panel.

Prior to joining the Bar, Olivia worked at Protect (a leading legal whistleblowing organisation).


Public Inquiries and Reviews

Olivia was instructed as a key member in the inquiry counsel team on the Thirlwall Inquiry, set up to examine events at the Countess of Chester Hospital and their implications following the conviction of former neonatal nurse Lucy Letby of murder and attempted murder of babies at the hospital.

She recently assisted in the Langdale Review and was led by Rachel Langdale KC. The review was commissioned by the Chief Constable of the Police Service Northern Ireland (PSNI) to provide independent scrutiny and constructive challenge in relation to the PSNI’s work addressing violence against women and girls.

Olivia is a member of the Attorney General C-Panel.


Court of Protection and Family Law

Olivia regularly appears in the Court of Protection in matters concerning health and welfare and property and affairs. She routinely has conduct of deprivation of liberty proceedings. She is regularly instructed on behalf of P (by the Official Solicitor, ALRs and other litigation friends) and by family members and local authorities.

She is experienced in advising on DoLS, and drafting written submissions, following the Attorney General for Northern Ireland v Lord Advocate [2026] UKSA 16 (“AGNI”) judgment that superseded ‘the acid test’ in Cheshire West.

Olivia is instructed in cross jurisdictional Court of Protection and family cases concerning forced marriage in circumstances where P has married and has later been found to lack retrospective capacity to marry and/or have sexual relations at the relevant time.

She co-authored an article on interim orders pursuant to s.48(a) Mental Capacity Act 2005 which she published in the Lexis Nexis Family Law Journal and featured in Barrister Magazine. Prior to joining the Bar, Olivia was an Independent Mental Health/Capacity Advocate.

Olivia undertakes public and private children law proceedings and also international cases, including matters concerning the Hague Convention 1980.

She appears in financial remedy matters, fact-finding hearings, and care proceedings. Olivia has acted in numerous child arrangement and non-molestation order hearings.


Clinical Negligence and Personal Injury

Olivia regularly advises claimants and defendants on liability, merits, causation, quantum and settlement.

Olivia’s background in cardiac physiology and familiarity with health and social care settings enables her to grasp medical evidence quickly. She is experienced and confident in holding conferences and discussions with medical experts.

She has experience of advising on high value claims including negligent pharmaceutical and surgical treatment, psychiatric injury, dental treatment, obstetric and gynaecological treatment and fatal claims under the Law Reform (Miscellaneous Provisions) Act 1935 and the Fatal Accidents Act 1976.

Olivia has experience of joint settlement meetings and mediation.
