David Earl has a busy common law practice which encompasses matrimonial finance and children cases, crime, employment and civil work.
Crime
David regularly appears in the Crown Court and undertakes complex cases in the Magistrates’ Court. David is a Grade 2 CPS Prosecutor. His cases have involved multi-handed drugs conspiracies, money laundering prosecutions, offences against the person, fraud and sexual offences. He also regularly receives instructions from HMRC and the Insolvency Service.
Family
David has a particular interest in matrimonial finance proceedings, regularly appearing at FDR appointments and final hearings. David also undertakes private law children work, often on a Direct Access basis or involving an international element. He acts for local authorities, parents and guardians in care proceedings and accepts instructions in Forced Marriage and Court of Protection work.
Employment
David has represented both claimants and respondents in the employment tribunal, building on experience gained before coming to the Bar while working in a human resources position for an international NGO. Cases have included unfair dismissal, discrimination – including that arising out of disability, sex and age – and pay disputes.
Civil
David’s civil work encompasses personal injury and clinical negligence, as well as applications under the Companies Act 2006 and Insolvency Act 1986.

- R v B (2024) – Prosecution for fraud committed upon an elderly victim, exploited by his neighbour, who operated in an informal carer role.
- R v H and others (2023) – Junior prosecution counsel in a multi-handed Class A drug dealing conspiracy with associated allegations of modern slavery offences.
- R v A and others (2023) – Prosecution for money laundering offences arising out of the blackmail of university student, whose bank cards had been stolen.
- R v M and others (2022) – Junior prosecution counsel in a multi-handed Class A drug dealing conspiracy in Gainsborough, Lincolnshire, with evidence from test purchase officers.
- R v S and others (2022) – Prosecution for money laundering offences arising out of a multi-handed drugs conspiracy.
- R (Insolvency Service) v Various (ongoing) – Involved in a number of ongoing prosecutions related to alleged fraudulent applications for Covid-19 Bounce Back Loans.
- R v S (ongoing) – Defending in an appeal against magistrates’ decision not to impose Football Banning Order following an affray.

- B v W (2024) – Achieving a favourable settlement at a Private FDR for a wife of a 10-year marriage, concluding protracted and acrimonious proceedings.
- BCC v A (ongoing) – Representing the father on a direct access basis in applications to attain parental responsibility and declarations of parentage following the death of the child’s mother.
- SM v L (2024) – Resolving a children dispute with an agreement for regular contact for a Colombian mother who had made an application pursuant to Article 21 Hague Convention 1980.
- B v B (2024) – Appearing for a husband in a three-day final hearing, which involved allegations of assets being held overseas.
- S v O (2023) – Resisting an appeal in a matrimonial finance dispute against the judge’s findings re: the husband’s assets overseas and litigation conduct, achieving a costs order for a legally aided respondent.
- K (ongoing) – Involved in a complex Forced Marriage Protection Order case concerning a protected person with speech and hearing difficulties alleged to have been unable to consent to his marriage to a party overseas.
- C v C (2023) – Resisting an application to set aside decree absolute.

- A v B (2023) – Representing an NHS Trust in a preliminary hearing to ascertain whether the claimant had a disability within the meaning of the Equality Act 2010.

- N v M & M (2023) – Advising on quantum and settlement of a Hand Arm Vibration Syndrome claim brought by a polisher whose working life involved over 30 years’ exposure to vibrating tools at multiple employers.
- W v S (2023) – Advising on the correct formulation of a Smith v Manchester/Blamire award following a workplace accident which exacerbated the claimant’s back injury and led to psychological difficulties.
- G v ECC (2023) – Advising a local authority on settlement of a multi-track s.41 Highways Act 1980 claim.
- B (2023) – Application pursuant to s.216(3) Insolvency Act 1986 for permission to act as a director.
- A v G (2022) – Achieving a significant award of general damages in a multi-track trial concerning negligent surgery to remove excess skin.
