Simon Wheatley obtains Clinical Negligence damages in missed diagnosis of rectal cancer case PM v University College London Hospitals NHS Foundation Trust.
The claimant, a 36-year-old man, received £850,000 total damages after sustaining injury and loss due to a delay in diagnosing a cancerous polyp located in his rectum. Liability was initially denied, but then partial admissions were made in relation to breach of duty, with causation continuing to be denied. As a result of the delay, the claimant underwent an open low anterior resection and adjuvant chemotherapy. He continued to suffer altered bowel frequency, episodic faecal incontinence and faecal urgency. The Claimant also suffered erectile dysfunction in consequence of the surgery. He developed a depressive illness of moderate severity.
