Court of Protection

The Court of Protection makes decisions about the management of finances and welfare of people who lack mental capacity to make decisions for themselves.

7BR’s Court of Protection barristers undertake work across the court’s jurisdiction, in both property and finance and welfare cases. Members act for public bodies, family members and for protected parties.

Many members of the Court of Protection team are also specialists in allied areas, such as public law, clinical negligence and child and family law.

We are able to assist in all aspects of the Court of Protection process, whether that be by advice pre-action, assisting in the initial application or through representation thereafter.

Cases include:

  • Re NRA & Ors [2015] EWCOP 59, where Charles J considered the process for authorising a deprivation of liberty
  • Re EU [2014] EWCOP 21 (Fam), appointment of deputy, and;
  • Re MRJ [2014] EWCOP B15, suspension of a lasting power of attorney
