Helen Rodger has a busy and broad common law practice including clinical negligence, personal injury and inquests, general crime, financial crime and mental capacity. She is well placed to conduct complex cases demanding knowledge of more than one area of law and advises swiftly on discrete points straddling a number of legal jurisdictions.

Prior to coming to the Bar, Helen worked at the Infected Blood Inquiry supporting the counsel team’s investigations into Government decision-making relating to infected blood products since the 1970s. She also worked as a youth advocate at a legal charity supporting vulnerable children and young people with immigration, homelessness, social care and criminal justice issues.

Alongside her work in Chambers, Helen undertakes pro-bono work and is particularly interested in improving access to the bar, acting as a mentor for Bridging the Bar and other organisations.

Legal Expertise

Clinical Negligence and Personal Injury

Helen maintains a busy paper practice in personal injury and clinical negligence, advising in multi-track claims from pre-action to resolution. She appears regularly in fast-track trials in the County Court acting for both claimants and defendants.

Recent cases have involved: mismanaged care for individuals with significant learning disabilities; negligence in emergency care during the Covid-19 pandemic; historic abuse claims, and; negligent surgery to various areas of the body.

Thanks to her previous experience in family law, Helen regularly advises on the disclosure regime and applications arising in civil historic abuse claims brought against Local Authorities, where access to the documents before the Family Court during care proceedings often needs to be handled sensitively.

Helen is a member of the Personal Injury Bar Association.


Inquests

Helen is regularly instructed in multi-day inquests representing family members in cases where issues of clinical negligence have arisen and where Article 2 is engaged. She is experienced in cross-examining medical professionals and experts.

Helen welcomes instructions at an early stage, enabling her to advise from the outset on the evidence and submissions necessary to secure all relevant evidence at the final inquest hearing.


Court of Protection

Helen has a busy practice in the Court of Protection working with clients who lack capacity, as well as family members and public authorities. Her personal injury and clinical negligence practices compliment this area of her work.

Recent instructions have included:

  • successfully resisting an application by the Office of the Public Guardian to require a parent providing extensive gratuitous care to their child to pay rent and subsistence for living with them;
  • acting in an application for an injunction to prevent a family member from attending the private care home P resided in;
  • cases involving the international relocation of P, and;
  • representing a family member where P has recently transitioned from Children’s Services to Adult Social Care.

Helen is a member of the Court of Protection Bar Association.


General Crime

Helen has extensive experience in the Magistrates and Crown Courts, as both sole and junior counsel. Recent instructions include prosecuting the perpetrator of a bomb scare as sole counsel, and as prosecution junior in a multi-handed drugs conspiracy. Helen has advised in cases touching on complex legal issues, conducting cases involving the insanity defence and issues pertaining to fitness to plead. She is currently instructed as junior counsel in a multi-handed attempted murder.


Financial Crime

Helen has a particular interest in fraud and corporate crime. She has experience advising in corporate investigations, on issues pertaining to legal privilege. She has worked on investigations led by the Serious Fraud Office.

Helen is a member of the Fraud Lawyers Bar Association and the Young Fraud Lawyers’ Association.
