Emily Mitchell has developed a diverse practice in family law. Her particular expertise relates to children matters, both in private and public law proceedings and she also practices in international child abduction.

Emily has experience conducting cases involving complex allegations of abuse, including physical and sexual abuse. She is regularly instructed in fact-finding hearings concerning serious injuries to children. Her experience as a clinical negligence practitioner and her familiarity with medical evidence is very helpful. She acts for all parties in care proceedings and has particular expertise in representing vulnerable clients. Emily often appears in cases before the High Court and against Leading Counsel.

Emily was ranked as a Rising Star in the Chambers & Partners 2022 guide and has been ranked consistently throughout the years. Legal Expertise

Family Law

Emily has developed a diverse practice within Family Law. Her particular expertise relates to children matters, both in Private and Public Law Proceedings. She also practices in International Child Abduction.

Emily has experience in conducting cases involving complex allegations of abuse, including physical and sexual abuse, in both Public Law and Private Law proceedings. She is regularly instructed in Fact-Finding hearings concerning serious injuries to children. Her experience as a clinical negligence practitioner and her familiarity with medical evidence is advantageous in this respect. In Public Law proceedings, she is frequently instructed as trial counsel and has experience representing all parties at Final Hearing. She has acted for vulnerable adults with significant learning difficulties.

In private law proceedings, Emily has experience in cases where matters of domestic violence and sexual abuse are alleged. She has acted for both victims and those alleged as having perpetrated the abuse. She has acted in cases where complex ABE issues and the questioning of children have been raised.

Emily has appeared in cases before the High Court and against Leading Counsel. She has recently acted as a Junior representing a Mother in a complex fact-finding concerning allegations of non-accidental injury arising from a low level fall with conflicting medical evidence.

Notable Family Law cases

A Father v A Mother (No2) (Art 21 Findings of Fact) [2025] EWHC 952 (Fam) (ongoing)

Represented the Respondent Father. F was unsuccessful in seeking summary return of the children to US and commenced Article 21 proceedings. M had made wide-ranging and extreme allegations of domestic violence perpetrated by F against her and the children. MacDonald J found that M was dishonest and had fabricated her allegations.

MKCC v RA & CA & JA [2025] (ongoing)

Care proceedings involving significant allegations of sexual abuse/grooming and predatory behaviour perpetrated by the parents against three vulnerable teenage complainants who are not the subject child.

S (Children: Transnational Marriage Abandonment) [2025] EWCA Civ 1058

Ongoing wardship proceedings now before Hayden J. Significant findings of transnational marriage abandonment and parental alienation against F.

Norfolk County Council v YY (Mother) [2025] EWFC 480

Care proceedings concerning the parents' biological child, age 12 and their adopted child, age 2.

London Borough of Brent v A and others (Wardship; return order) [2025] EWHC 44 (Fam)

Wardship proceedings before Theis J. Emily represented the child, aged 17 years, who had fled to Denmark to be with her girlfriend. The child sought to remain in Denmark, and Theis J declined to make a return Order, and requests were made pursuant to Article 33 of the 1996 Hague Convention for placement in Denmark. Emily represented the child through her child's guardian after the decision on summary return.

Court of Protection

Emily accepts instructions in respect of both welfare and property and affairs matters in the Court of Protection. She acts on behalf of protected parties and local authorities.

Emily’s incisive nature allows her to get to the heart of an issue quickly, which results in effective solutions for her clients. Her experience in the family court means she is sensitive in dealing with parties with vulnerabilities and difficulties, whilst her personal injury and clinical negligence practice means she is adept at working with complex medical notes.
