
On 21 May 2026, Jeffrey Jupp KC and Chris Canning will appear for the respondents in the Supreme Court in the case of Barton Turns Developments Limited v Treadwell, heard alongside the linked appeal of Wicked Vision Limited v Rice.
The appeal concerns the statutory construction of section 47B(2) of the Employment Rights Act 1996. Section 47B relates to liability for subjecting a claimant who “blows the whistle” to detriments. The court will decide whether section 47B(2) exempts an employer from vicarious liability for its employee or agent, where the employee or agent subjects the claimant to qa detriment, and that detriment is the claimant’s dismissal. There are conflicting Court of Appeal decisions on this point, which the Supreme Court is expected to resolve.
