
Anita Guha KC acted for the Appellant in the Court of Appeal in an international family law case, Re B, published on 4 November.
Anita successfully challenged the decision of the Deputy High Court Judge to order the return of the subject child to Portugal in a 1980 Hague Convention abduction case. The Court of Appeal accepted that the trial judge erred in law in his approach to the Article 12 defence of settlement and has given valuable guidance upon the legal principles to be applied.
