Charlene Henderson successfully represented the father at a relocation final hearing in private law proceedings, securing the return of the child to England after he was taken to Scotland without his consent when he was 3 months old.
The child had been living in Scotland for 18 months by the time of the judgment hearing. Charlene persuaded the Judge to depart from the Cafcass officer’s recommendation that the child should continue to live in Scotland with the mother. The Court agreed that the only way of ensuring the child has a meaningful relationship with his father, is if the child returned to Northamptonshire.
