7BR’s Elaine Banton was successful in the Court of Appeal case, HSBC v Chevalier-Firescu [2024] EWCA Civ 1550.
The Court of Appeal gave judgment on 11 December 2024, unanimously dismissing the employer’s appeal.
The appeal arose out of the decision of the Employment Tribunal to strike out Ms. Chevalier-Firescu’s claims of race and sex discrimination and victimisation, on the basis that they were out of time. Elaine did not appear below in the ET but succeeded in the Employment Appeal Tribunal (EAT) appeal on all grounds, then HSBC appealed to the Court of Appeal.
