In Dell v Ghattas the claimant, a chartered accountant and cyclist, was found to be fundamentally dishonest about both his injuries and the accident. Evidence revealed that he stopped his bike by the traffic lights outside the Royal Albert Hall, invited the motorist to strike him, and threw his bike under the car to stage the scene.
The chartered accountant cyclist falsely claimed he was struck by a Land Rover and immediately took photos and a video at the scene for the purposes of mounting a claim.
