Jeffrey Jupp and Jim Robottom, instructed by Priestleys, succeed in the Privy Council. The Privy Council holds that the Commissioner of the Cayman Islands Police acted unlawfully and in breach of section 19 of the Constitution by operating a rigid policy to the effect that officers forced to retire at 55 could only be offered re-engagement contracts at the rank of constable. The Privy Council also determines that a fixed retirement age is not within the ambit of the section equivalent to Article 8 ECHR so as to be discriminatory under Article 14.
