VC pursued a claim in clinical negligence alleging that Mr P had wrongly performed a variety of gynaecological procedures upon her over several years, including the implantation of a tension free vaginal tape – obturator (a ‘TVT-O’). Her case was that she was not properly consented to the various procedures performed upon her and many of them were not even indicated given her particular clinical situation.
The TVT-O caused VC to suffer from pain, dyspareunia and some bowel symptoms. She suffered from a recurrence of her stress urinary incontinence. She underwent further surgical procedures to try and reposition her tape and to then partially remove it. Despite these surgeries she remained in pain and her quality of life was significantly adversely affected.
VC’s earning capacity had been reduced as a result of her injuries and she was likely to need further surgery and treatment to cope with her symptoms.
The case concluded at a JSM by way of an agreement to pay VC a lump sum in damages.
