Elaine Banton successfully defends an appeal in the Court of Appeal on 18th February 2020 before Lord Justice Underhill and Lord Justice Henderson in Kilraine v Lion Academy Trust [2020] 1085 EWCA/Civ: The notice period contained within the fixed term contract for a teacher applied and was not inconsistent with paragraph 4.1 of the Teachers’ Burgundy Book. The collective agreement (Burgundy Book) did not prevent the notice being operative within a fixed term contract. The appropriate notice was provided within the fixed term contract. The appeal was dismissed and the Respondent was awarded £25,000 costs.
