We are pleased to invite you to our upcoming Court of Protection seminar: Human Rights and Damages for Unlawful Deprivation of Liberty, hosted at 7BR on Wednesday 27th September at 5.30pm.
Richard Clayton QC and Lee Parkhill will discuss the scope for human rights act arguments within the Court of Protection, and will examine the relationship between Convention rights and the ‘best interests’ test under the Mental Capacity Act 2005. Speakers will discuss claims for damages for unlawful deprivation of liberty, paying particular attention to Essex County Council v RF & Ors (Deprivation of Liberty and damage)  EWCOP in which the court approved a settlement for unlawful deprivation of liberty at up to £4,600 per month. The session will consider whether such awards can be maintained.
