Derek Sweeting QC and Peter Ellis, instructed by Irwin Mitchell London Partner Alison Eddy, acted for the claimant child in EJC (A child by LMC) v East & North Hertfordshire NHS Trust. The claimant, now aged 11, suffered from hypoglycaemia due to inadequate feeding shortly after her birth at the Lister Hospital, Stevenage. Unfortunately this remained undetected prior to her discharge, and she suffered from irreversible brain damage. This resulted in multiple disabilities, including weakness of her limbs, blindness and learning disorder. The out of court settlement, agreed on the last day before trial, comprised of a lump sum of £5.25M, and periodical payments for nursing care and case management, with a capital value of about £16.8M. The settlement was approved by Mr Justice Foskett in the Royal Courts of Justice on 4 April 2017.
