Yesterday, Judgment was approved in the case of Haywood v University Hospital North Midlands NHS. The judgment in the case of Haywood bucks the recent trend of the NHSLA winning trials on liability. While it does not involve any new or novel legal issues the analysis of the facts may be of interest, not least because the Defendant’s obstetric expert, Derek Tufnell, came in for some criticism from the judge, Mr Justice Holroyd (paragraphs 114 to 118).
