Court of Appeal gives guidance on adoption and placement orders

On 20 May 2008 the Court of Appeal handed down judgment in the case of P (A Child) [2008] EWCA Civ 535, in which the Court provided welcome guidance on aspects of the Adoption and Children Act 2002. In particular it clarified the widely debated test for dispensing with parental consent to adoption and placement orders, and approved of the adoption agency practice of dual-track planning. Perhaps most significantly the Court’s ruling may have opened the door to a more interventionist judicial approach to post-adoption contact.
