Hugh Preston wins PUWER case for defendant in the House of Lords

20 May 2009

The House of Lords gave judgment today in Smith v Northamptonshire County Council.

The decision concerns the extent to which employers may be liable under the Work Equipment Regulations for equipment outside their control.

It will be of interest to all employers liability personal injury practitioners, particularly those acting for or against employers of staff who work outside the employer’s normal place of work.

The House of Lords ruled in favour of the defendant, represented by Hugh Preston of 7 Bedford Row.
