Dr Peter Ellis is ranked by The Legal 500 and Chambers & Partners as a leading junior in clinical negligence at the London Bar: “...impresses sources with his medical know-how, approachability and depth of knowledge beyond that of his contemporaries... you win cases with him because he helps everyone through the evidence calmly and effectively and makes over-aggressive hired guns seem foolish...". He is instructed by many of the UK's leading firms on complex clinical negligence cases, including birth and brain injury claims. His practice benefits from his experience as a former hospital doctor specialising in internal medicine. Dr Ellis is experienced at representing parties at round table settlement conferences, mediations and other forms of ADR. He is a CEDR trained mediator. He has mediated a dispute involving a fertility clinic which mishandled stored sperm, and numerous disputes for Central London County Court. He also acted as a jointly instructed single expert to determine a dispute between an insurer and its insured, in a complex neurosurgical case involving aggravation of congenital hydrocephalus.

Recent cases include:

  • Carrigan v Barts & The London NHS Trust: delay in diagnosis of epidural haematoma complicating implantation of spinal cord electrode, paraplegia. Out of court settlement, capital value £3.7M.
  • Defoe v Luton & Dunstable Hospitals NHS Trust. Failure to diagnose congenital cardiac arrhythmia, brain damage. Out of court settlement, capital value £4.0M.
  • Hayhurst v Cambridge University Hospitals NHS Trust: brain injury during radiological vascular procedure. Out of court settlement, capital value £5.5M.
  • R v Epsom & St Helier Hospitals NHS Trust. Delay in diagnosis of brain tumour, blindness, out of court settlement £1.35M.

Dr Ellis is the author and editor of the clinical negligence chapter in Butterworths’ Personal Injury Litigation Service. He is an assistant editor of Tottel’s Law of Limitation, and a regular contributor on clinical negligence topics to the new electronic law journal PIBULJ (XPL Publishing).

Dr Ellis is also a regular speaker and chairman at national and regional clinical negligence conferences and meetings. Recent engagements include:

  • Speaker on “expert evidence in birth injury claims”, annual C5 Advanced Obstetric Negligence Forum, London - Chairman of the annual AvMA new fee earners’ clinical negligence conference, Birmingham.
  • Provision of in-house training on expert report writing and giving evidence in court for the Medicines & Healthcare Regulatory Agency and the Royal College of Surgeons. 

Dr Ellis is a member of the Professional Negligence Bar Association, the Medico-Legal Society, the Society of Doctors in Law, and the Faculty of Forensic & Legal Medicine at the Royal College of Physicians of London.
