David practices in  Employment and Commercial and Chancery litigation.  He has considerable breadth of experience in other fields which is particularly useful in “cross-over” cases.   David is an Accredited Commercial Mediator. 


Employment

David specialises in employment work, with particular emphasis on discrimination claims as well as senior executive restrictive covenant and breach of confidence work.  He frequently appears in the Employment Tribunal, EAT and CA dealing with all areas of employment law including sex, race and disability discrimination and TUPE.


Commercial Litigation and Civil Fraud

David also specialises in commercial litigation including civil fraud, misrepresentation, and the other commercial torts, acting for both Claimant and Defendant in the Chancery Division, Companies Court and Queen’s Bench Division.  Recent heavy civil fraud actions have included both “ordinary” civil litigation and as the basis for unfair prejudice petitions in the Companies Court.

Recent Interesting Employment Cases

  • Dunbar v NSPCC – multi-applicant redundancy/unfair dismissal – Guernsey Employment & Discrimination Tribunal – judgment reserved
  • Garrett v Lidl - disability discrimination, victimisation and harassment - Tribunal and EAT and Tribunal again – won on all 31 different allegations.   A significant case in which the EAT ruled that an employer may lawfully refuse to make adjustments to accommodate a disabled employee at their existing workplace if the adjustments can best be achieved at another workplace which is nearby, at least if the employee is subject to a mobility clause and has worked at a number of locations.
  • Rentokil v Prokill – acting for the Defendants in a heavy and aggressively litigated case concerning restrictive covenants, confidential information and copyright/database rights; in responding to a search and seizure order, defeated an attempt to obtain a summary order for costs – after much initial sparring settled on advantageous terms at mediation.
  • Incisive Media v Global Partnership - confidential information and database rights – ex employees set up in competition after taking various documents.
  • Jackson v Compass Group – Tribunal, sex discrimination – defeated claim based around alleged pregnancy related discrimination – 5 days in ET.
  • Specialist Marine Services v Dalby Offshore Services – breach of copyright/database rights/confidence/duty of fidelity.
  • Hick Lane Bedding v Zafar – Co Director/employee duties.
  • Nottingham City Council v Green EAT – race, victimisation and unfair dismissal.
  • Equal Opportunities Commission v Lidl (S. 71 Sex Discrimination Act claim for injunctions regarding maternity policy)
