David has particular expertise in financial related matters, international issues and public law issues.
Financial
David has a particular expertise in financial regulation and commercial fraud (both criminal and civil) and is also frequently instructed where there are offshore issues.
He defends cases brought by the Financial Services Authority ('FSA') being instructed in proceedings both in the High Court and the Regulatory Decisions Committee ('RDC') of the FSA and he has conducted a 6 month regulatory investigation for the Jersey Financial Services Commission ('JFSC'). He has considerable experience of the application of the ‘fit and proper’ test by regulators.
He has advised a Middle Eastern Government prior to and during a Financial Action Task Force ('FATF') inspection.
International
David is one of the most experienced of his call in the full range of international issues that may arise in civil, regulatory and criminal law.
He advises on issues such as jurisdiction and conflict of laws in civil proceedings and has advised an international mining company on investment arbitration in the ICSID. He has vast experience of international criminal mutual legal assistance, having worked and spoken on this subject in countries throughout the world. He has appeared in extradition proceedings in the Administrative Court.
David is called to the Queensland and Australian Federal bars, is currently called to the bar in the Turks and Caicos Islands for a specific case and has acted as junior counsel in hearings in the Indian courts.
Public Law
David is a former tutor in public law at the London School of Economics and Political Science ('LSE').
He has been instructed in a number of cases in Jersey which have involved public law issues.
His clients in the Administrative Court have included the Attorney General for Jersey and the Chief Crown Prosecutor for Cambridgeshire.
