The Upper Tribunal found that, whilst the First-tier Tribunal ought to have considered evidence up until the date of the hearing, such error was minor and did not amount to an error of law. Consequently, the Respondent was enjoyed a retained right of residence under the Immigration (European Economic Area) Regulations 2006.
