Gemma Lindfield
Extradition forms a substantial part of Gemma's practice. She has
extensive experience in all matters relating to extradition law, with an
interest in mutual legal assistance. Gemma was seconded as a Senior
Crown Prosecutor within the Special Crime Division of the Crown
Prosecution Service where she handled an exclusively extradition
caseload. Gemma represents judicial authorities, governments and defendants in extradition proceedings and also appears before the High Court. In 2006, Gemma attended Rwanda to advise on extradition, which resulted in extradition requests according to a special arrangement
between the UK and Rwanda in respect of four men whose extradition is sought for genocide and crimes against humanity. She has been involved in drafting European arrest warrants and extradition requests for persons sought by the UK. Gemma has represented the Crown as junior
counsel in an application to stay proceedings as a Bennett style abuse of process.
Gemma is junior counsel acting for the Government of Rwanda who seek the extradition of four men to face prosecution for genocide and crimes against humanity in Rwanda. As a result of this involvement, Gemma assisted the Rwandan government to prepare amicus briefs before the UN
International Criminal Tribunal for Rwanda in the application by the
Prosecutor of the Tribunal to transfer cases to Rwanda.
Other recent cases include representing the Government of USA in the extradition request someone involved in an international advance fee
fraud where the defendant is arguing issues relating to the Attorney General’s Guidelines. Gemma has represented the Russian Federation as junior counsel in respect of a request for a former Yukos official in relation to alleged tax fraud and in respect of other complex fraud allegations relating to the shipping company Sovcomflot. Gemma also talks on the subject of extradition at in-house and external seminars.
