Employment

Alex joined chambers in October 2009 following completion of a year’s pupillage. During that time he trained under Timothy Walker, one of chambers’ leading employment specialists, from whom he gained a great breadth of experience in high-end employment litigation.

Whilst still a pupil Alex fought and won a two-day unfair dismissal claim, beating an offer of settlement by some £4,000. In his first year of independent practice, Alex has twice been instructed to appear in the Employment Appeal Tribunal, winning both times. In May 2011, Alex succeeded in bringing an appeal on behalf of his employee client in a case concerning retirement and unfair dismissal: Bailey v R&R Plant (Peterborough) Ltd (UKEAT/0370/10). The decision has important ramifications for those currently serving out notices of retirement, and has attracted considerable comment among practitioners. In Hira Company Ltd v Daly (UKEAT/0135/10/RN), Alex successfully resisted an appeal brought by employers against a tribunal’s majority finding of constructive dismissal.

Alex acts for both employees and employers. Recent clients have included a barristers’ clerk, and an employer facing a disability discrimination claim where covert surveillance cast serious doubts on the claimant’s credibility. In addition to unfair and wrongful dismissal cases, he has also acted in matters involving TUPE, minimum wage disputes, direct and indirect sex and disability discrimination, and various worker issues (including part time worker discrimination, and disputes over whether a claimant is a statutory worker, an employee, or self-employed). He is willing to advise in the pre-action and pre-hearing phases of litigation. Although still a junior practitioner Alex has already conducted complex trials lasting three to five days, with hundreds of pages of evidence and difficult issues of law. Recently, he acted for a claimant in a claim brought against eighteen individual respondents.

Alex also speaks on employment law issues and has delivered seminars to large practitioner audiences.
